The contractor must also indemnify, hold harmless, and defend the City and its officers, members, agents, and employees from any claims, demands, actions, causes of action, and costs made by anyone on account of the performance of the contract. The contract award will be based on the lowest responsible bid, considering value received for monies expended. The City will evaluate the bids based on the qualities of the articles supplied, their conformity with the specifications, and their suitability to the requirements of the City and the delivery terms. The City will also consider intangible factors, such as the contractor's reputation and past performance.
