Description
The Texas Comptroller, on behalf of the Texas Prepaid Higher Education Tuition Board, is seeking qualified law firms or individual attorneys to serve as outside counsel for a multi‑plan tuition‑savings program. The successful respondent will provide legal advice on municipal securities disclosure, FINRA/MSRB rules, IRC 529/529A qualified tuition plans, and a broad range of general legal matters (family, contracts, probate, IP, fiduciary, tax, etc.). Work is on an as‑needed basis, invoicing each plan separately, with an initial contract term from Dec 1 2026 through Aug 31 2028 (≈21 months) and two optional one‑year renewals. The maximum contract value is $150,000. Key dates include posting 8/21/2026, questions due 8/28/2026, proposals due 9/29/2026 (2 PM CT), oral presentations 11/17/2026 (if required), and contract execution 12/1/2026.
• Required experience: municipal securities, FINRA/MSRB, 529/529A plans, and government entity representation.
• Deliverables: legal opinions, research, representation at Board meetings, billing per plan, compliance with Texas attorney fee guidelines.
• Mandatory submission items: transmittal letter, firm/attorney bios, hourly rates, conflict disclosures, VetHUB subcontracting plan, signed proposal.
• Evaluation: 80 % competence/qualifications, 20 % fee reasonableness.
• No travel reimbursement except pre‑approved expenses; maximum compensation capped at $150 k.
