Standard Recovery - Guatemala (Follow-on)

The Export-Import Bank of the United States (EXIM Bank) is seeking a contractor to provide asset protection and recovery services for a follow-on contract in Guatemala. The contractor will be responsible for collecting outstanding amounts owed to EXIM Bank by the obligor/buyer and all guarantors. The services will include asset searches, site visits, negotiations, litigation, documentation of agreements, embargoing assets, and executing upon assets. The contractor must have knowledge of the Guatemalan judicial system and be duly qualified/registered as an attorney in Guatemala if litigation is pursued. The key tasks and responsibilities of the contractor include: • Providing collection services and servicing of defaulted loans • Conducting borrower negotiations, restructuring, and workout agreements • Instituting legal proceedings and providing credit restructuring services • Taking other actions required to effect recovery for EXIM Bank • Providing a written report outlining the plan for recovery and estimated amount of the defaulted principal that is collectable • Forwarding a written report to the Requesting Officer outlining the costs and risks associated with the anticipated filing fee(s)
