Description

The Export-Import Bank of the United States (EXIM Bank) is seeking a contractor to provide loan recovery assistance for certain paid claims under its credit guarantee and insurance programs. The contractor will be responsible for providing all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform loan recovery services. The scope of work includes asset searches, site visits, negotiations, litigation, documentation of agreements, embargoing assets, and executing upon assets. The contractor must have experience in locating assets, drafting/negotiating restructuring agreements, and litigating collection matters at all levels of courts in Brazil. The contractor must also be a law firm registered/licensed in the Brazilian Bar Association to practice law in Brazil. • The contractor will provide collection services and servicing of defaulted loans, including borrower negotiations, restructuring, and workout agreements. • The contractor will institute legal proceedings and provide credit restructuring services as required to effect recovery for EXIM Bank. • The contractor will provide a written brief on a frequent basis, at a minimum on a quarterly basis for active cases, to discuss the life cycle of the cases and enable the Contracting Officer's Representative (COR) to understand the particular situations surrounding the progress of the case. • The contractor will provide a Collected Funds report not later than fifteen calendar days after notifying the COR of incoming funds and identify the fee to be received based on the percentage of all monies actually collected.

Budget estimate

$100,000 – $200,000

The budget amount for this opportunity is not explicitly stated in the document. However, based on the scope of work, which includes loan recovery assistance for certain paid claims under EXIM Bank's credit guarantee and insurance programs, it can be estimated that the budget amount will be a percentage of the total amount recovered. The document mentions that the contractor's compensation for Task 2 services is limited to the negotiated contingency fee percentage, and no expenses will be reimbursed unless approved by the Contracting Officer's Representative (COR). Assuming an average recovery amount of $1 million and a contingency fee percentage of 10-20%, the budget amount could be estimated to be in the range of $100,000 to $200,000. However, this is a rough estimate and the actual budget amount may vary depending on the specific terms of the contract and the performance of the contractor.
