C038101 - DBE Orientation and Training Services for NYSDOT

On May 26, 2026, the New York State Office of the State Comptroller granted the New York State Department of Transportation (NYSDOT) an exemption for competitively advertising, thus approving its single source justified selection for Memorandum of Agreement with MH Miles Company, CPA PC for a change in the scope of services for the DBE Orientation and Training Services for NYSDOT based on an Interim Final Rule (IFR) from the U.S. Dept of Transportation effective October 3, 2025 that requires (DOT or Department) operate its Disadvantaged Business Enterprise (DBE) Programs in a nondiscriminatory fashion—in line with law and the U.S. Constitution. The IFR removes race and sex-based presumptions of social and economic disadvantage that [the Department asserts] violate the U.S. Constitution. Further, all firms that have a DBE certification are decertified with the issuance of the IFR and the goal shall be 0% on all contracts that have a DBE goal and there shall be no further DBE monitoring on the program. Pursuant to NY State Finance Law Section 163.10 (b), the Department is stating that competitive procurement was not feasible. There are no active procurement opportunities for this agreement.
