Intent to Sole Source

The U.S. Army Corps of Engineers (USACE), Buffalo District, intends to modify an existing contract for Buffalo Harbor maintenance dredging on a sole-source basis. The contractor, Morrish Wallace Construction, Inc. d/b/a Ryba Marine Construction Co., will increase the dredging quantities due to a vessel grounding in the fall of 2025. This additional work is considered outside the scope of the existing contract. The Government is seeking to modify the existing contract to include this additional dredging, citing the authority of Federal Acquisition Regulation (FAR) 6.302-1(c)(2)(i) and (ii). • The existing contract was awarded to Morrish Wallace Construction, Inc. d/b/a Ryba Marine Construction Co. on 24 September 2025. • The contractor is scheduled to begin dredging operations on 16 June 2026. • The Government is seeking to modify the existing contract to include additional dredging due to a vessel grounding in the fall of 2025. • The modification will be done on a sole-source basis, citing the authority of Federal Acquisition Regulation (FAR) 6.302-1(c)(2)(i) and (ii).
