Interlocal Agreement, Watters Trail South Connection

This contract is an interlocal agreement between Collin County, TX and the City of Allen for the Watters Trail South Connection project. The City of Allen is responsible for arranging the construction of the project, and Collin County, TX will provide funding assistance up to $139,428. The project includes the construction of a concrete trail and the removal of a portion of the existing trail. The City of Allen will provide quarterly progress reports and a final accounting of expenditures to Collin County, TX. The contract also includes provisions for indemnification, venue, and severability. • The project is part of the 2018 Parks and Open Space Bond Program. • The City of Allen will be responsible for any costs that exceed the total estimated project cost. • The contract will continue in effect annually until the final acceptance of the project. • The parties agree to release, defend, indemnify, and hold harmless each other from any claims or causes of action arising out of the performance of the contract.
