Description

The Export-Import Bank of the United States (EXIM Bank) is seeking a contractor to provide asset protection and recovery services for outstanding amounts owed to EXIM by obligors/buyers and guarantors in Mexico. The contractor will be responsible for performing asset searches, site visits, negotiations, litigation, and other actions to effect recovery. The contractor must have knowledge of the Mexican judicial system and be a duly qualified/registered attorney in Mexico if litigation is pursued. The scope of work includes collection services, loan recovery, and credit restructuring. The desired outcome is the recovery of outstanding debt. Some key tasks and deliverables include: • Performing a preliminary research and evaluation of the case • Attempting extrajudicial collection of the claim amount within 90 days • Filing legal proceedings against the debtor and guarantors if necessary • Providing regular and ad-hoc meetings between the contractor and the government • Submitting written reports to the requesting officer outlining the plan for recovery and estimated amount of defaulted principal that is collectable.

Budget estimate

$100,000 – $500,000

The budget for this contract is likely to be a contingency fee based on the actual cash recoveries. The total buyer debt for the claim in Mexico is not specified, but the contractor will be responsible for recovering outstanding amounts owed to EXIM Bank. Assuming the contractor is able to recover a significant portion of the debt, the budget could be substantial. However, without knowing the total debt amount, it is difficult to estimate the exact budget. The factors that may influence the likely payment range include the contractor's success in recovering debt, the amount of debt recovered, and the terms of the contingency fee agreement. Based on these factors, a rough estimate of the budget could be between $100,000 and $500,000, depending on the contractor's performance and the total debt recovered.
